1. Acceptance of Terms

By accessing, browsing, submitting a request through, or otherwise using the Platform, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Platform.

These Terms are a legal agreement between you and PockeTech LLC (doing business as “PockeTech Pro,” “we,” “us,” or “our”). If you are using the Platform on behalf of a business or other entity, you represent that you have authority to bind that entity.

2. About the Platform

PockeTech Pro provides a digital platform designed to help homeowners and other users connect with independent third-party service providers for home services (such as HVAC, roofing, windows, flooring, bathroom upgrades, and other categories that may be offered from time to time).

No account is required to submit a service request. You choose what information to provide. We use that information primarily to route your request to relevant independent providers and to facilitate communication.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these requirements and that the information you provide is accurate and current.

The Platform is intended for use within the United States unless we state otherwise. Certain features may be unavailable in some areas.

4. Service Requests & Matching

When you submit a service request, you may be asked for information such as your service category, job details, location (city/state), preferred timeframe, and contact information. You agree to provide accurate details so that contractors can evaluate and respond to your request.

4.1 Request Routing

Requests are forwarded to independent contractors based on factors such as your location, the requested service category, and availability. We do not guarantee that you will receive responses, quotes, or appointments.

4.2 No Emergency Services

The Platform is not intended for emergency situations. If you have an emergency (gas smell, active fire hazard, flooding, immediate risk of injury), call local emergency services and/or a qualified professional directly.

5. Third-Party Contractors

Contractors and service providers you may be matched with through the Platform are independent third parties. They are not our employees, agents, partners, joint venturers, or representatives.

5.1 No Endorsement or Warranty

We do not endorse any contractor and do not make warranties about licensing, insurance, quality, safety, pricing, reliability, or legal compliance. You are responsible for evaluating contractors and making your own hiring decisions.

5.2 Your Agreement Is With the Contractor

Any services performed are subject to the contractor’s terms, quotes, schedules, warranties, and policies. Any agreement for work is strictly between you and the contractor.

6. Pricing, Quotes & Payments

The Platform may display estimated ranges or informational pricing content. Such information is for convenience only. Actual pricing depends on job conditions, materials, codes, and contractor policies.

Unless explicitly stated otherwise on the Platform, PockeTech Pro does not set contractor pricing. Payment terms, deposits, financing, refunds, or chargeback policies (if any) are handled by the contractor or payment processor.

7. Communications Consent

By submitting a request or providing contact information (such as phone number or email), you consent to be contacted about your request by PockeTech Pro and/or independent contractors by phone, email, and text message (including automated or prerecorded messages where permitted by law).

Communications may be needed to confirm details, schedule appointments, or provide quotes.
Message and data rates may apply depending on your carrier and plan.
You can opt out of texts by replying “STOP” where applicable.

Consent to receive communications is not a condition of purchase. If you opt out, it may limit our ability (or a contractor’s ability) to respond to your request.

8. User Submissions

You may submit information, notes, photos, descriptions, or other materials (“Submissions”). You retain ownership of your Submissions, but you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and transmit those Submissions as reasonably necessary to operate the Platform and route your request to relevant contractors.

You represent you have the right to submit the content and that it does not violate laws or the rights of others.

9. Prohibited Uses

You agree not to:

Use the Platform for unlawful, harmful, fraudulent, or deceptive purposes.
Submit false information or impersonate others.
Attempt unauthorized access, scrape data, or bypass security measures.
Upload malware or code designed to disrupt systems or users.
Harass, threaten, defame, or discriminate against others.

We may restrict or terminate access if we believe you have violated these Terms.

10. Intellectual Property

The Platform and all related content—including text, design, graphics, logos, icons, and software—are owned by or licensed to PockeTech Pro and protected by law. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Platform.

11. Disclaimers

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, POCKETECH PRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted or error-free operation or the accuracy/completeness of contractor information or availability results.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POCKETECH PRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY SERVICES PROVIDED BY CONTRACTORS.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY WILL NOT EXCEED US $100, OR THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations. In those jurisdictions, some limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless PockeTech Pro and its affiliates from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Platform, your Submissions, your violation of these Terms, or your disputes with contractors.

14. Privacy

Your use of the Platform is subject to our Privacy Policy. In general, we use information you provide to route your request and facilitate communication with independent contractors.

15. Termination

We may suspend or terminate access if we believe you have violated these Terms or created risk for the Platform or others. You may stop using the Platform at any time.

16. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date above. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the State of Arizona.

Unless otherwise required by applicable law, disputes will be brought in the state or federal courts located in Arizona, and you consent to personal jurisdiction and venue in those courts.
